Terms of use

The terms that apply when you use merc4n (merc4n.com, the web app and the iPhone app). How your personal data is processed is described in the privacy policy and the KVKK notice.

The service

merc4n is an AI assistant that works for you in the apps you connect (mail, calendar, files and others). Every action that creates or changes a record is done with your approval. The service is provided by Cenk Coşkun (contact: support@merc4n.com).

Your account

You open your account on app.merc4n.com with your first name, last name, phone number and e-mail. Do not share your password or the codes sent to you; you are responsible for what is done with your account. You can delete your account yourself at any time in the app (on the web under Hesap › Gizlilik › Hesabımı sil, on the iPhone under Hesap › Hesabımı sil).

Packages and subscriptions

• Pro: 1,000 questions or tasks a month. Maximum: 3,500 questions or tasks a month. The business package (Kurumsal) is quoted.
• Subscriptions are bought in the iPhone app with your Apple ID, through the App Store, and renew automatically every month. The price is shown in the App Store, in Turkish lira, before you buy.
• Free trial: the first subscription is free for 1 month, once per Apple ID. Unless you cancel at least 24 hours before the trial ends, the monthly price of the package you chose is charged when it ends.
• Payment is charged to the payment method of your Apple ID when you confirm the purchase. The subscription renews every month at the same price unless cancelled at least 24 hours before the end of the period; the renewal is charged within the 24 hours before the period ends.
• You manage or cancel your subscription on the iPhone under Settings › Apple ID › Subscriptions. A cancellation takes effect at the end of the current period; your package stays on until then.
• Questions and tasks renew with every subscription period; what is unused does not carry over. A question is every message of yours that gets an answer; a task is every routine or job that runs for you.
• Refunds for App Store purchases are requested from Apple under Apple's rules. Apple is not a party to these terms and is not responsible for the merc4n service.

Other people's personal data: your responsibility

When you add other people's personal data to merc4n (a candidate's CV, the e-mails of people you write to, people in your documents, records in your business apps), you decide why and how it is processed, so under the Turkish Personal Data Protection Law No. 6698 (KVKK) you are its data controller and merc4n is the data processor acting only on your instructions. The rules are in the data processing agreement (in Turkish). You are responsible for having a legal basis for the data, informing the people concerned before adding it, avoiding special categories of data, deleting it when its purpose ends and answering their requests. If a claim or fine reaches merc4n because of your breach, you bear it in proportion to your fault.

Hiring features

CV tracking reads only the mailbox and Dosyalar folder you choose, once you start it, and candidates' data is processed only by our own model in Türkiye. Scores, rankings and summaries support your decision and can be wrong: you make the decision about a candidate yourself, and a candidate may object to a result produced solely by automated analysis (KVKK Art. 11). Characteristics such as age, gender, religion, health or a photo are never accepted as criteria; complying with the ban on discrimination in hiring is your responsibility. Candidates' data is deleted after one year unless you delete it earlier.

Use

You use merc4n lawfully and only with your own accounts. Accessing other people's accounts or data without permission, unlawful monitoring or profiling of people, discrimination, spam, sending automated requests that overload the service, or using it to produce harmful content is not allowed and may lead to the account being closed. AI answers can be wrong and are no substitute for a lawyer's, accountant's or doctor's advice: check them before important decisions.

Liability

merc4n is not liable for decisions you make without checking the answers, for the results of actions done with your approval, for errors of third-party apps you connect, or for use that breaches these terms. Nothing here limits liability for intent or gross negligence (Turkish Code of Obligations Art. 115) or your mandatory rights as a consumer.

Acceptance, changes and governing law

You accept these terms and the data processing agreement when you finish signing up; we record which version you accepted, when, and from which IP address and browser, and keep that record for ten years after your account is deleted. If they change, the new version is published here with its version number and you are asked to accept it the next time you use the app. Turkish law applies; consumers may apply to the consumer arbitration committees and consumer courts under Law No. 6502.
